Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Misbau LLC (“Company”, “we”, “us”, or “our”), a company registered in the United Arab Emirates at Sharjah Media City, P.O. Box 130130, Sharjah. They govern your use of Murmy, our mobile application for iOS and Android, and any related services (together, the “Services”).

Murmy is a relaxing, single-player game. Using one finger, you lead a flocking swarm of light to bloom dormant “buds” into flowers of light as the scene shifts from night toward dawn. It has no accounts, no competition, and no fail states. The main journey is free to play, with an optional one-time in-app purchase that unlocks an endless “wander” mode. Game progress is stored locally on your device.

By downloading or using Murmy, you agree to these Terms. If you do not agree, please do not use the Services. You can reach us at [email protected].

1. Who can use Murmy

Murmy is intended for a general audience. If you are a minor in your jurisdiction, you may use the Services only with the consent and involvement of a parent or guardian, who agrees to these Terms on your behalf. To make a purchase, you must be of legal age to form a binding contract in your jurisdiction, or have the consent of your parent or guardian. By using the Services, you confirm that you meet these requirements and that you will use Murmy in compliance with all applicable laws.

2. Your licence to use Murmy

We grant you a personal, limited, revocable, non-exclusive, non-transferable licence to install and use Murmy on devices you own or control, for your own personal, non-commercial enjoyment, in accordance with these Terms and the rules of the app store you downloaded it from.

You agree not to: (a) copy, modify, or create derivative works of the Services; (b) reverse engineer, decompile, or attempt to extract the source code, except to the extent applicable law permits; (c) remove or obscure any copyright, trademark, or other proprietary notices; (d) use the Services for any unlawful purpose or in any way that could damage, disable, or impair them; (e) use automated means (bots, scrapers) to access or interfere with the Services; or (f) use the Services to build a competing product.

3. Our intellectual property

We own or license all rights in the Services, including the code, audio, visuals, design, text, and the “Murmy” name and logo (collectively, our “Content and Marks”). They are protected by intellectual property laws. Your licence above does not transfer any ownership to you, and we reserve all rights not expressly granted. You may not use our Content or Marks for any commercial purpose without our prior written permission; requests can be sent to [email protected].

4. Purchases

Murmy offers an optional one-time in-app purchase that unlocks the endless “wander” mode. All purchases are made and processed through the Apple App Store or Google Play, under their respective terms and using their payment systems. We do not receive or store your payment details.

Prices are shown in the app store before you buy, in your local currency, and may vary by region and change over time. Any applicable taxes are handled by the app store. The unlock is a one-time, non-consumable purchase tied to your app store account, and can be restored on your devices through the store’s “restore purchases” function.

5. Refunds

Because purchases are processed by Apple and Google, refunds are handled by them under their own policies. To request a refund, please use the App Store or Google Play refund process for your account. Nothing in these Terms limits any statutory consumer rights you may have under the laws of your country, including any non-waivable rights to a refund.

6. Acceptable use

You agree to use Murmy only for its intended, lawful, personal purpose. You will not interfere with the operation or security of the Services, attempt to gain unauthorised access to any systems, or use the Services in violation of any applicable law or the rights of others.

7. No accounts, no user content

Murmy does not use accounts and does not ask you to register or sign in. It does not provide any feature for you to submit, post, upload, or share content, and it does not host user content. Your game data lives only on your device and is removed when you delete the app.

8. Apple and Google app store terms

This section applies when you download Murmy from the Apple App Store or Google Play, and is required by those stores.

• These Terms are an agreement between you and Misbau LLC only, not with Apple or Google. We, not Apple or Google, are solely responsible for the app and its content.
• Your licence to use the app is limited to use on devices you control, as permitted by the applicable app store’s usage rules.
• Apple and Google have no obligation to provide any maintenance or support for the app.
• To the maximum extent permitted by law, Apple and Google have no warranty obligation for the app, and any claims relating to the app are our responsibility, not theirs.
• Apple and Google are not responsible for addressing any claims by you or a third party relating to the app, including product-liability, legal/regulatory, or intellectual-property claims.
• You represent that you are not located in a country subject to a relevant government embargo and are not on any prohibited-parties list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Google is likewise a beneficiary of the provisions in this section.

9. Privacy

Our handling of information is described in our Privacy Policy, which is incorporated into these Terms. In short, Murmy does not require an account and does not collect personal information about you; game data stays on your device, and purchases are processed by Apple, Google, and RevenueCat. Please review the Privacy Policy for details.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MISBAU LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM, OR USD 100, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; nothing in these Terms limits liability that cannot be limited by law.

12. Indemnification

You agree to indemnify and hold harmless Misbau LLC from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Services or your breach of these Terms or applicable law.

13. Term and termination

These Terms apply while you use the Services. You may stop using Murmy and delete it at any time. We may suspend or discontinue the Services, or restrict access, where reasonably necessary — for example, to comply with law, protect the Services, or address misuse. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and dispute resolution) will survive.

14. Governing law

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Subject to the dispute-resolution section below, you and Misbau LLC irrevocably agree that the courts of the United Arab Emirates have exclusive jurisdiction over any dispute arising in connection with these Terms.

15. Dispute resolution

If a dispute arises, the parties will first try to resolve it informally by contacting each other. If it cannot be resolved informally, it will be finally settled by binding arbitration administered by the Dubai International Arbitration Centre (DIAC) in accordance with the DIAC Arbitration Rules in effect at the time of the dispute. There will be one (1) arbitrator; the seat of arbitration will be Dubai, United Arab Emirates; the language will be English; and the substantive law will be that of the United Arab Emirates.

Arbitration will be conducted on an individual basis only — not as a class, consolidated, or representative action. The following are not subject to arbitration: (a) disputes about the validity or infringement of a party’s intellectual property; (b) claims of theft, piracy, or unauthorised use; and (c) claims for injunctive relief, which may be brought in the courts identified above. Nothing here prevents you from bringing matters to the attention of relevant regulators, or limits non-waivable rights under the law of your country.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and for material changes we will provide a more prominent notice. Your continued use of the Services after changes take effect means you accept the updated Terms.

17. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. You agree that we may communicate with you electronically and that electronic communications satisfy any legal requirement that such communications be in writing.
