Terms of Use

These Terms and Conditions ("Terms") govern your use of the NextRep mobile application ("App"), operated by Misbau LLC ("we", "us", "our"), a company registered in the United Arab Emirates. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are using the App on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

NextRep is a fitness and wellness application designed to help users over 40 maintain an active lifestyle through personalised workout plans, progress tracking, wellbeing check-ins, and optional partner/couples features. The App is available on iOS devices via the Apple App Store.

3. Important — Fitness and Health Disclaimer

Please read this section carefully before using the App.

NextRep provides general fitness information and personalised workout suggestions for informational and educational purposes only. The App does not provide medical advice, diagnosis, or treatment.

3.1 Consult a Doctor First

Before beginning any exercise programme, including those suggested by NextRep, you should consult a qualified medical professional or physician, particularly if you:

  • Are over 40 years of age
  • Have any pre-existing medical conditions, including but not limited to heart disease, diabetes, high blood pressure, osteoporosis, or arthritis
  • Have suffered any recent injury, illness, or surgery
  • Are pregnant or postpartum
  • Have any concerns about your physical fitness or health

3.2 Exercise at Your Own Risk

Physical exercise carries inherent risks, including but not limited to muscle strain, joint injury, cardiovascular events, and in rare cases, death. By using NextRep workout plans and suggestions, you acknowledge and accept these risks. You agree that:

  • You are solely responsible for your physical wellbeing during exercise
  • You will exercise within your own limits and stop immediately if you experience pain, dizziness, shortness of breath, or discomfort
  • The workout plans generated by the App are suggestions only and may not be suitable for your individual health circumstances
  • Misbau LLC and NextRep are not liable for any injury, illness, or health consequence arising from use of the App

3.3 No Medical Relationship

Use of the App does not create a doctor-patient, physiotherapist-patient, or any other professional health relationship between you and Misbau LLC or NextRep. The App is not a substitute for professional medical or fitness advice.

4. Account Registration

To use the full features of the App, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorised use of your account
  • Be responsible for all activity that occurs under your account

We reserve the right to terminate accounts that violate these Terms or contain inaccurate information.

5. Subscriptions and Payments

5.1 Free and Paid Features

NextRep offers both free and premium subscription tiers. Premium features are accessible only to subscribers. Details of subscription pricing are displayed within the App at the time of purchase.

5.2 Billing

Subscriptions are billed through Apple In-App Purchase. Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period. Payment will be charged to your Apple ID account at confirmation of purchase.

5.3 Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. Refunds are handled by Apple in accordance with their refund policy. We do not process refunds directly.

5.4 Price Changes

We reserve the right to change subscription prices. We will provide reasonable notice of any price changes. Your continued use of the App after a price change constitutes acceptance of the new price.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or extract the source code of the App
  • Use automated tools to scrape, crawl, or extract data from the App
  • Interfere with or disrupt the App or servers connected to it
  • Upload or transmit harmful, offensive, or illegal content
  • Impersonate another person or entity
  • Share your account credentials with others

7. Intellectual Property

The App, including its content, design, code, workout plans, and all associated intellectual property, is owned by Misbau LLC or used under licence. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.

You may not copy, reproduce, distribute, modify, or create derivative works of any part of the App without prior written permission.

8. Partner / Couples Mode

The partner linking feature allows two users to share workout plans and accountability data. By linking with a partner, you consent to sharing your workout progress, streak data, and plan information with that partner. You may unlink a partner at any time through the Profile settings. We are not responsible for disputes arising between linked partners.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Misbau LLC provides the App on an "as is" and "as available" basis without warranties of any kind, express or implied
  • Misbau LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
  • Misbau LLC's total liability to you for any claim arising from these Terms or use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim
  • Misbau LLC is not liable for any injury, illness, or health consequence arising from following workout plans or fitness advice provided by the App

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Misbau LLC from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your data as described in the Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

13. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately.

14. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.
